General Terms and Conditions for the Use of TGS

 

 

 

Preamble

With the registration as a member of Travel Global Source (hereinafter referred to as "TGS") you accept (hereinafter referred to as the "member") the following General Terms and Conditions (hereinafter referred to as the "GTC") for the use of TGS.

The contractual relationship between the member and TGS is regulated in this GTC.

The services offered by TGS exclusively addresses persons of legal age who have

a professional status with a focus on the tourism industry.

1. Subject Matter

1.1. The TGS Website is a Community platform, on which the members can exchange data and information, as long as it does not offend laws or this GTC.

1.2. The TGS Website can be used in two ways: (1) an open site for non-members to

read news and information as well as (2) a private free of charge platform for the initiation of business contacts and exchange of information (hereinafter referred to as the “community”).

 

2. Registration

2.1. The use of the Community services of the TGS Website presupposes the registration as a member. The registration is free of charge. By opening a member account under acceptance of this GTC among other rules and regulations you may register. A claim for membership on the TGS Website may not be put into account.

2.2. Each member may register only once and create only one member profile.

2.3. The password selected during the registration must remain secret and may not be passed on to any third party.

2.4. The data queried by TGS during the registration has to be indicated completely and correctly, e.g. name and surname, the current address and telephone number, a valid E-Mail address as well as the company. If a change of the indicated data occurs after the registration, then the member is obliged to correct the data in his member profile immediately towards TGS.

2.5. TGS does not guarantee for the actual identity of a member. Each member is

instructed to convince himself of another members identity.

2.5. TGS reserves the right to close the member profile of a not completely accomplished registration.

 

3. Obligations of the members

3.1. The member is obliged to only provide true data in his profile and his communication with other members.

3.2. The member is obliged to only use current photos (not older than 2 years), on

which he is well recognizable.

3.3. The member is obliged to follow valid laws as well as respect all rights

regarding third parties. Content provided by the member may not offend valid law or this GTC. It is in particular forbidden to

- engage in unfair competition (cf. § 3 of the German Unfair Competition Act).

- provide misleading advertisement (cf. § 5 of the German Unfair Competition Act)

- provide insulting or slanderous content

- use or offer pornografic content or content offensive against the protection of children and young people laws

- trouble other members in an unreasonable way (spamming), (cf. § 7 of the German Unfair Competition Act)

3.4. The following actions are forbidden:

- to send chain letters.

- to use mechanisms, software or any other scripts in connection with the use of the TGS Website which can disturb the function of the TGS Website.

- to send or store data onto a data medium of TGS which may be harmful to the enterprise, server or infrastucture of TGS by condition (e.g. viruses), size or duplication (e.g. spamming).

- to block, overwrite or modify content generated by TGS or disturbing the TGS Website in any other way.

- to copy, spread, multiply or use content in any other way from the TGS Website without previous agreement of the right owners. This also applies to copying in the way of "Robot/Crawler" searchengine technology or by other automatic mechanisms.

4. Responsibility for content, information and/or data provided by members

4.1. TGS does not take responsibility for content, the information and/or data on the TGS web page, which were made available by the members. Furthermore TGS may not be held responsible for content on linked external Websites.

4.2. Complaints about other members can be reported over the link “contact” or by the link “report user” within the members profile.

5. Range of service

5.1. TGS provides the under § 1 described Community platform for the members.

5.2. The member may only insist on to date state of the art technology regarding the

services of the TGS-Website. TGS may limit its performance temporarily when

capacity borders are reached or when the safety or integrity of the servers or when

technical measures are necessary to provide a better performance (maintenance

work).

5.2. The member agrees to receive a newsletter via E-Mail.

5.3. The member can terminate the membership at any time by using the "unregister" link from the own profile page ("upgrade your profile").

6. Liability

6.1. TGS may not be held responsible for the issues described in § 4.1. The member exempts TGS from all responsibilities regarding claims for damages due to a violation of their rights made by other members or any third parties for content or services provided by the TGS-Website.

7. Data Protection

7.1. TGS records, converts and uses your personal data under adherence to the data protection acts of the Federal Republic of Germany and the data protection regulations of the European Union.

7.2. TGS uses your personal data exclusively, in order to make the registration requirements for the TGS Community services available to you.

TGS will not pass on your personal data for advertising or marketing purposes to any third parties.

8. Final Clauses

8.1. TGS reserves the right to amend these GTC at any time, without giving reasons.

The changed conditions are sent to the member by E-Mail at the latest two weeks before becoming applicable. If the member does not contradict the validity of the new GTC within two weeks after receipt of the E-Mail, the amended GTC is considered accepted.

8.2. If a determination of these GTC is ineffective, the remaining regulations remain unaffected by it.

8.3. The place of delivery of any obligations and/or performances under these GTC shall be TGS’s main place of business.

8.4. To the extent admissible by law or statue, exclusive venue for all legal disputes arising from these GTC and/or the contractual relationship between the parties shall be TGS’s main place of business.

8.5. These GTC and the contractual relationship shall be governed exclusively by the applicable laws and statutes of Germany, without regard to its choice of law rules and excluding the provisions of the United Nations Convention on Contracts for the International Sale of Goods.
